XXXX XXXX directly refused to comply with the original contract. Because they refused to comply with the original contract they were not entitled to any money until a new agreement was created and signed by both parties. At the time when XXXX XXXX made the request of Wells Fargo to obtain the balance of {$3800.00}, they did not have my signature on the document. XXXX XXXX voided the original contract and had no legal authority to request money from Wells Fargo at that time and provided false statements that the job was completed. Therefore, Wells Fargo should not have extended this payment to XXXX XXXX because there was no new agreement. XXXX XXXX refused to install the fourth window and refused to comply with the building code as required by law. Since the original contract signed on XX/XX/year> was breached by XXXX XXXX, and their second contract was unsigned by either party, XXXX XXXX committed fraud by submitting the second unsigned contract for payment when they breached ; and thus Wells Fargo was not authorized to approve payment. I wrote Wells Fargo concerning the breach well before the payment and was told by phone that no payment would be authorized without my signature. Sincerely, XXXX XXXX XXXX XXXX.
