Consumer Narrative

I respectfully disagree with the companys response and conclusions. I do not own the accounts referenced ( Account Numbers XXXX and XXXX ), and I filed an FTC Identity Theft Report stating that these accounts are fraudulent. I am submitting this feedback and creating a new CFPB case because the previous case was closed without resolving the identity-theft issue under the controlling provisions of the Fair Credit Reporting Act ( FCRA ). The companys response relies almost entirely on FDCPA verification standards and internal review. However, FDCPA XXXX does not establish ownership and does not override identity-theft protections under FCRA XXXX XXXX XXXX XXXX confirm that a debt exists in a creditors records, but it does not prove that I opened, authorized, or benefited from the account. Once an FTC Identity Theft Report is filed, credit reporting agencies are required to block identity-theft-related information, and furnishers must reassess whether continued furnishing is lawful. The company acknowledges it is a data furnisher and does not own the accounts. As a furnisher, it still has obligations under FCRA 623 ( a ) to ensure accuracy and to stop furnishing information it knows or should know is inaccurate once identity theft has been asserted. Repeating information supplied by a clientwithout original proof of my authorizationdoes not satisfy this obligation. The response also requests that I provide proof that I did not set up services at a specific address or provide a police report. The FCRA does not require a police report to trigger identity-theft blocking when an FTC Identity Theft Report has been submitted. The burden is not on the consumer to disprove a debt after identity theft is asserted ; rather, the law requires blocking unless the report is shown to be materially false. Importantly, the companys response does not provide : A signed application or contract bearing my signature ; Proof of identity verification at account origination ; Evidence that I personally authorized or benefited from the accounts ; or Evidence rebutting my FTC Identity Theft Report. Because these deficiencies remain, the accounts should be blocked and removed, and reinsertion protections must be enforced. Closing the prior CFPB case did not resolve the issue, which is why I am pursuing this matter through a new case and requesting CFPB oversight to ensure compliance with FCRA 605B and 611 ( a ) ( XXXX ) ( B ). I respectfully request that the CFPB note that : I do not own these accounts ; I filed an FTC Identity Theft Report ; FDCPA verification does not resolve identity theft ; FCRA requires blocking and suppression of fraudulent information ; and Continued treatment of these accounts as valid causes ongoing harm.
