Instead of addressing my concerns, Midland simply re-sent its XX/XX/XXXX response verbatim, without providing any new explanation or clarification. To date, Midland has still failed to address the following points : The unexplained discrepancy between the originally stated fee balance of {$3000.00} and the later claim that bankruptcy-related attorney fees total {$1400.00}. No explanation has been provided as to where the remaining amount came from or why the figures changed. The contractual basis for assessing bankruptcy attorney fees against me when I did not file bankruptcy, my mortgage was not included in any bankruptcy case, and my wife ( who filed individually ) is not a borrower on the loan and has no ownership interest in the property. Any citation to specific language in the note or mortgage that authorizes Midland Mortgage to charge these fees under these circumstances. Midlands failure to respond substantively to these issues, after they were clearly raised, is concerning. Repeating a prior response without addressing the actual dispute does not resolve the matter. In addition, Midland Mortgage did not prove that they were unable to begin foreclosure proceedings, and if that is the case, attorney fees should not have been assessed to begin with. I am requesting supervisory review of this complaint and ask that Midland be required to provide a complete, good-faith response that directly addresses the discrepancies and identifies the contractual authority they are relying upon.
