Part I : Background Plaintiff was previously employed at XXXX XXXX XXXX. 2. On or about XX/XX/XXXX, XXXX resigned from said corporation. 3. Prior to this resignation, beginning XXXX, Plaintiff was subjected to harassment when a XXXX XXXX and XXXX XXXX ( XXXX ) Governance Lead on a federal contract by the company. 4. The Defendant Selene Finance LP who is mortgage servicer and debt collector failed to provide a 60-day notice required by Va. Code 55.1-321 especially given the background of the details in my attachments. 5. Plaintiff alleges that the Defendant are using the foreclosure process as an Abuse of Process to carry out a retaliatory agenda related to the XXXX 's XXXX XXXX resignation and subsequent political/professional stances. Part II FORMAL NOTICE OF ERROR AND REQUEST FOR INFORMATION PURSUANT TO 12 C.F.R. 1024.35 AND 1024.36 ( RESPA ) ; AND NOTICE OF INTENT TO SEEK INJUNCTIVE RELIEF FOR RETALIATORY ABUSE OF PROCESS. To the Mortgage Servicer/Selene Finance LP This letter is a " qualified written request '' under Section 6 of the Real Estate Settlement Procedures Act ( RESPA ). I am writing to formally dispute the foreclosure action currently being taken against my property. I believe this foreclosure is both fraudulent in its execution and retaliatory in its motive. I. NOTICE OF ERROR ( 12 C.F.R. 1024.35 ) I assert that the following servicing errors have occurred : Violation of Virginia Code 55.1-321 : You have failed to provide the mandatory 60-day written notice required for owner-occupied residential real estate in Virginia prior to a trustee sale XXXX II. I demand an immediate internal investigation into the communications and motives behind the decision to accelerate this loan and schedule a trustee sale. III. REQUEST FOR INFORMATION ( 12 C.F.R. 1024.36 ) To verify the validity of this debt and the legality of your standing to foreclose, provide the following within 30 business days : 1.A copy of the original Promissory Note with all endorsements showing the current holder. 2.The complete " Life-of-Loan '' transactional history, including an itemized list of all fees and " Corporate Advances. '' 3.All internal servicing notes and communication logs from XX/XX/XXXX to the present, which I believe contain evidence of retaliatory intent. 4.Verification of compliance with the " Face-to-Face '' meeting requirement given it is FHA-insured or the " Notice of Default '' requirements under the Deed of Trust. IV. STATUTORY NOTICE OF INTENT Pursuant to Regulation X, you must acknowledge this electronic letter within 5 business days.
