Consumer Narrative
XXXX XXXX agreed to cancel my timeshare contract for a fee of {$3400.00}. I did not have that much and said to forget it, but they insisted I could pay half then and half later when the service was finished. This was noted in the contract which was not valid to begin with and never mentioned anything about a third party ( Affirm ) handling the payments. Affirm states that they pay the merchant the entire amount up front and set up a payment plan for me to repay them. I made the payments for the first half {$1700.00}. Then I realized I had received nothing from XXXX XXXX about their attempts or progress to cancel the timeshare contract which should have been done by now unless they were sitting around doing nothing. I asked them about it and they said they would not start working on canceling the contract until they received the total {$3400.00} which they had received up front from Affirm. So I filed a dispute with Affirm to cancel any future payments for the reasons stated above and get a refund of my {$1700.00} yjat I had already paid. Affirm went against me because they said XXXX XXXX provided proof that the job had been completed and I owed them the last {$1700.00} which they had already paid XXXX in the beginning. Neither Affirm or XXXX could show me this proof. They had also cancelled the contract at one point and then later said it was a mistake and it was not cancelled. During this time when I thought it was cancelled, I hired a reputable person to cancel the contract which he did in a few days. He also said the timeshare said they had never been contacted by XXXX to cancel the contract, so I have proof that they never offered any proof to Affirm that they did the job. So why doesn't Affirm get their money back from XXXX instead of harrassing me for the money. XXXX had also continuously sent me nasty and threatening emails so I finally blocked them and they even sent me a XXXX threatening letter. I owe them nothing and they owe me a {$1700.00} refund. I can't see where there is any question about my timeshare XXXX threatening letter. I owe them nothing and they owe me a {$1700.00} refund. I can't see where there is any question about this.
