Consumer Narrative
I am filing a complaint about the inaccurate and inconsistent reporting of several auto charge-off accounts on my Experian credit report dated XX/XX/year>. Experian is reporting the following auto loans as charged off with large past-due balances, updated in XXXX : XXXX XXXX XXXX XXXX XXXX Acct XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX Acct XXXX XXXX XXXX XXXX XXXX XXXX Acct ending XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX Acct XXXX XXXX XXXX XXXX not denying that these auto loans existed or that the vehicles were repossessed in the past. I am disputing the way Experian is reporting them today, because the information is inconsistent, incomplete, and misleading compared with other official records and my previous dispute history. Equifax dispute history and current reporting On XX/XX/year>, Equifax completed a reinvestigation of these same auto loans after my written disputes. In the dispute results and in my current Equifax credit report dated XX/XX/year>, Equifax now reports these auto accounts in a much different way than Experian. For example : The XXXX XXXX XXXX XXXX loan and the XXXX XXXX ( acct ending XXXX ) are shown on Equifax as closed accounts without an active charge-off / past-due status, instead of large past due balances updated in late XXXX. The XXXX / XXXX XXXX XXXX ( acct ending XXXX ) is flagged as a historical charge-off that was previously in dispute and resolved by the furnisher, not as a currently active installment with a newly updated past-due balance. In other words, XXXX current reporting and the prior dispute results show that these are old, resolved or closed charge-off accounts, while Experian continues XXXX treat them as if they were active delinquent auto loans with fresh past-due balances. Both versions can not be maximum possible accuracy under the Fair Credit Reporting Act ( FCRA ). XXXX XXXX XXXX no response to direct dispute I previously sent a direct written dispute to XXXX XXXX XXXX regarding the auto loan ending XXXX. XXXX never responded to my direct dispute, but Experian continues to report the account as fully verified and charged off with a large past-due balance. If the furnisher does not respond and a different bureau ( Equifax ) has already softened the status to a closed account without active past-due amounts, Experian should not continue publishing this as a verified, current charge-off with a large deficiency balance. XXXX XXXX XXXX XXXX XXXX prior CFPB case and internal XXXX balance I previously filed a CFPB complaint about the XXXX XXXX XXXX XXXX XXXX XXXX loan ( acct ending XXXX ). The case number was ECW250106-01498-R1, and it was handled by the Chase Executive Office . After that complaint : In my XXXX online profile, this auto loan now shows a XXXX balance and closed status. On XX/XX/year>, XXXX sent me an Interest Paid Letter stating that interest paid was not available and year-to-date interest paid is not available. This suggests that Chases internal records for this account are incomplete, or that the loan is no longer treated as an active, collectible installment account. Despite this, Experian still reports the XXXX XXXX XXXX XXXX loan as a charged-off auto account with a past-due balance of approximately {$21000.00}, with recent update dates in late 2025. This conflicts directly with Chases own system ( XXXX balance / closed ) and with the fact that XXXX could not even provide basic interest information on the account. Why this violates the FCRA Under the FCRA, including sections 602A, 607 ( b ), 611, and 623, Experian must : Maintain maximum possible accuracy, Correct or delete information that is inaccurate or can not be properly verified, and Not continue publishing data that conflicts with other bureau data, prior dispute results, and furnishers current records. Right now, Experians versions of these auto loans do not match : My Equifax dispute results from XX/XX/year>, My current Equifax report from XX/XX/year>, and Chases current internal status ( XXXX balance / closed ) for the XXXX XXXX loan. I understand that repossessions occurred in the past, and I am not trying to erase history. I am asking that these accounts be reported accurately and consistently, instead of being treated as newly updated, active charge-offs with large past-due balances when other evidence shows they are closed, resolved, or no longer being collected in that way. Requested resolution : Require Experian to conduct a full reinvestigation of all the auto accounts listed above with each furnisher ( XXXX, XXXX XXXX XXXX XXXX, XXXX XXXX, XXXX ). Either DELETE these auto charge-off tradelines from my Experian report, or UPDATE them so they accurately reflect their true current status ( closed, XXXX balance, charged to loss / resolved ), without active past-due deficiency coding that suggests current billing. Remove any misleading recent charge-off / past-due status where the balance has already been charged to loss, set to XXXX, cancelled, sold, or otherwise resolved by the furnisher. Provide me with the method of verification for each auto account, including the name and contact information of each furnisher and how the data was verified. I am simply asking that my auto accounts be reported in a way that is accurate, complete and consistent across the credit bureaus, in compliance with the FCRA.
