Consumer Narrative

I do not owe this debt, my daughter opened a Discover charge account in XXXX of XXXX without my knowledge and she confessed she was paying for it until it was too much for her. She enrolled it in a credit consolidation service program with XXXX XXXX XXXX on XXXX of XXXX. She pays {$350.00} a month to them and was hoping that they were negotiating with Discover to come to a settlement. Unfortunately that didn't happen and in XX/XX/XXXX Discover filed suit. My daughter reached out to XXXX XXXX XXXX when she found out in XXXX when they tried to serve me at her address. XXXX XXXX XXXX tried to negotiate with the creditor, the balance of the debt is {$8800.00} and they only brought it down to a little over {$7000.00} with monthly payments of {$290.00} a month which is not really a decent offer. Due to the aggressiveness of this Creditor and the fact that their attorneys at XXXX XXXX XXXX have never reached out or provided any proof that they sent out demand letters prior to filing suit my daughter removed this Creditor from the program with XXXX XXXX XXXX She filed an answer to the court with a personal letter to the judge explaining the situation and also submitted a settlement agreement to lower the debt to {$5300.00} and make monthly payments of {$200.00}. No one has reached out to settle this and the court has denied the settlement agreement. I am upset with all of these companies for not following standard legal procedures. With XXXX XXXX XXXX for not reaching out sooner to the Creditor and just having it sit there for a year in a program you thought was handling this. The complaint states that Discover merged with XXXX XXXX as of XX/XX/XXXX yet I never received anything prior to XXXX from XXXX XXXX, Discover or XXXX and XXXX stating that they were taking legal action or we could've handled this outside of litigation. My daughter has power of attorney to handle this debt in my name now but XXXX XXXX from XXXXXXXX XXXX XXXXXXXX nor anyone from his office has communicated when they said they would.
