Merchant : XXXX ( {$2400.00} ) FTC Report Number : XXXX I am filing this complaint against American Express for failing to conduct a reasonable investigation into a " Services Not Rendered/ Misrepresented '' dispute, as required by the Fair Credit Billing Act ( FCBA ). The Facts : ( Please see the attached 4-page 'Rebuttal to Chargeback Dispute ' for a point-by-point refutation of merchant claims and copies of their own support tickets admitting the service failed. ) Failure to Deliver : I authorized a charge of {$2400.00} based on the contractual promise of " qualified, responsive leads. '' The merchant failed to deliver this. The majority of leads provided were unresponsive, and several were confirmed deceased through professional real estate lookup tools. Merchant Misrepresentation : The merchant claims I am " walking away '' with digital assets ( website/marketing ). This is false. These assets are proprietary to their platform and are disconnected upon termination, providing XXXX residual value. Predatory Refund Terms : The merchant 's refund policy is structured to be practically impossible to fulfill, requiring 12 months of daily XXXX activity on non-viable leads. This is a " bad faith '' contract term designed to circumvent consumer protection. Bank Failure : American Express closed my dispute stating the charge was " authorized. '' I have never denied authorization ; I am disputing the performance of the contract. Under the FCBA, banks are required to investigate when a merchant fails to deliver goods or services as agreed.
