I obtained a private student loan from XXXX XXXX to attend XXXX, an online coding bootcamp. In XX/XX/XXXX of XXXX Devslopes has since shut down ( see Discord screenshot for confirmation from XXXX XXXX ) and is no longer operational. In XXXX of XXXX Climb Credit ended it's partnership with Devslopes ( see subsequent emails attached ) After the school closed and became unresponsive, I contacted Climb Credit to dispute the loan and request a discharged ( phrased as forgiven in email ) due to the school 's closure and impossibility of performance. I formally invoked the FTC Holder Rule ( 16 C.F.R. 433.2 ), which makes the loan holder subject to all claims and defense against the seller, as well as contract impossibility under Restatement ( Second ) of Contracts 261 Climb Credit has refused to cancel or discharge the loan, stating that they require Devslopes to confirm and issue a refund before Climb Credit can act ( see email file provided ), however, Devslopes is closed, unreachable, and incapable of issuing refunds or confirmations, thus making their requirement impossible. By continuing to enforce the loan and requiring action from a non-existent school, Climb Credit is effectively denying relief via an impossible condition, despite being on notice of the school 's closure and my formal dispute ( see emails provided ).
