First, Spring Oaks Capital , LLC is a third-party collection agency that was hired by XXXX XXXX XXXX . Because this balance has been satisfied, I do not currently, nor have I ever, held an active account with Spring Oaks Capital , LLC. Despite this fact, Spring Oaks Capital , LLC is falsely reporting that I maintain an account with them. If a debt has been paid in full, no valid account exists, and continued reporting of such an account is inaccurate and misleading. Under the Fair Credit Reporting Act ( FCRA ), 15 U.S.C. 1681s-2 ( a ), furnishers of information have a legal obligation to ensure that all information reported to consumer reporting agencies is accurate and complete. Reporting an account as active or collectible when the debt has been paid in full constitutes inaccurate reporting and is a direct violation of this statute. Additionally, XXXX XXXX XXXX continues to report this {$800.00} balance on my credit report as of XX/XX/year>, despite the debt being satisfied. If XXXX XXXX XXXX has treated this debt as paid, settled, or canceled, they are required under Internal Revenue Service regulations and 26 U.S.C. 6050P to issue a Form 1099-C ( Cancellation of Debt ). To date, I have not received any such documentation. Continuing to report this balance without issuing the required tax documentation is improper and misleading. Furthermore, there is a separate collection account on my credit report in the amount of {$120.00} from a company called XXXX XXXX XXXX. I have no knowledge of this account, no prior business relationship with this company, and I did not provide permissible purpose or authorization for this account to be reported on my credit file. Pursuant to the Fair Debt Collection Practices Act ( FDCPA ), 15 U.S.C. 1692e, a debt collector may not use false, deceptive, or misleading representations in connection with the collection of any debt. Additionally, under 15 U.S.C. 1692c and 1692f, collection activity without proper validation or consumer authorization is prohibited. Reporting a debt that I do not recognize and did not authorize is a violation of these protections. I am formally requesting that the CFPB investigate these matters and require the following corrective actions : Immediate deletion of any account reported by Spring Oaks Capital , LLC related to the paid-in-full XXXX XXXX XXXX debt XXXX I also demand a Cease and Decease letter regarding this account immediately! Correction or removal of the XXXX XXXX XXXX account to accurately reflect a XXXX balance, and issuance of a Form 1099-C if the debt has been canceled or settled. Immediate removal of the {$120.00} XXXX XXXX XXXX account due to lack of authorization, validation, and permissible purpose. Assurance that all furnishers involved comply fully with the FCRA and FDCPA moving forward. These inaccurate and unauthorized entries are causing ongoing harm to my credit profile and financial standing. I respectfully request prompt intervention and resolution.
