Attached along with evidence of these accounts appearing on my report you will see my data was also compromised during the Equifax Data Breach. I am submitting this complaint regarding an unauthorized XXXX XXXX / line of credit allegedly opened by XXXX XXXX XXXX XXXX that is appearing on my Equifax credit report. I did not apply for, authorize, consent to, or benefit from this account. The account was opened as a result of identity theft and is fraudulent. " XXXX XXXX XXXX XXXX XXXX ACCOUNT NUMBER : XXXXXXXX XXXX XXXX XXXX XXXX XXXX FOR XXXX OPENED ON XX/XX/2020 Despite the account being unauthorized, XXXX XXXX XXXX XXXX has reported and continues to furnish this account to Equifax , where it is negatively affecting my credit score, credit history, and overall creditworthiness. The continued reporting of this fraudulent account has caused ongoing financial harm and violates my right to a fair and accurate credit report. Violations of Federal Consumer Protection Laws The furnishing and maintenance of this unauthorized account violate multiple federal consumer protection statutes, including but not limited to : 1. Fair Credit Reporting Act ( FCRA ), 15 U.S.C. 1681 et seq. 1681b ( Permissible Purpose ) : Consumer credit information may only be obtained, used, or furnished when a valid permissible purpose exists. I never initiated or authorized this account ; therefore, no permissible purpose exists. 1681s-2 ( a ) ( Duty to Furnish Accurate Information ) : Furnishers must not report information they know or should know is inaccurate, false, or the result of identity theft. 1681s-2 ( b ) ( Duty to Investigate Disputes ) : Upon notice of a dispute, furnishers must conduct a reasonable investigation and promptly correct, delete, or permanently block inaccurate or fraudulent information. 1681e ( b ) ( Maximum Possible Accuracy ) : Consumer reporting agencies and furnishers must follow reasonable procedures to assure maximum possible accuracy of reported information. 1681c-2 and 1681c-3 ( Identity Theft Protections ) : Information resulting from identity theft must be blocked from consumer reports and may not be reinserted once properly identified. 2. Fair Credit Billing Act ( FCBA ), 15 U.S.C. 1666 et seq. Protects consumers from liability for unauthorized credit card or credit account activity. Prohibits creditors from holding consumers responsible for accounts or charges they did not authorize. 3. Truth in Lending Act ( TILA ), 15 U.S.C. 1601 et seq. Requires valid consumer authorization, identity verification, and meaningful disclosures before opening or extending credit. Any extension of credit without my knowledge or consent violates TILA requirements. 4. Consumer Financial Protection Act ( CFPA ), 12 U.S.C. 5531 & 5536 Prohibits unfair, deceptive, or abusive acts or practices ( UDAAP ). Reporting and maintaining a fraudulent account that damages a consumers credit constitutes an unfair and abusive practice.
