To the Consumer Financial Protection Bureau, I am filing a complaint regarding my mortgage servicers handling of my COVID-19 forbearance repayment. I believe I was misled, not properly informed, and not provided the disclosures required by federal guidelines. As a result, a {$50000.00} subordinate lien was placed on my home in XXXX XXXXXX/XX/XXXXwithout my informed consent. Background During the COVID-19 forbearance period, I contacted my servicer to bring my loan current. I was specifically told that my missed payments would just go to the end of your loan. Based on this information, I agreed to the repayment option they offered. At no point did the representative explain that : my skipped payments would become a recorded subordinate lien, the repayment would take the form of a HUD Partial Claim or deferral lien, the lien would need to be paid in full if I refinance or sell, or a new mortgage note was being created and attached to my title. I was not informed of any lien, nor was I given a clear disclosure or explanation of the legal or financial implications. I do not recall signing any document authorizing this lien. I recently discovered it while checking county records. Concerns I believe the servicer may have violated federal servicing guidelines by : Providing misleading or incomplete information about the repayment structure. Failing to disclose the creation of a subordinate lien. Failing to provide required documents or obtain valid signatures authorizing the lien. Misrepresenting the terms of the forbearance repayment, leading me to believe payments were simply deferred. Recording a lien without informed borrower consent. Confirm whether the lien amount is accurate and whether improper fees or charges are included. Explain whether HUD or federal COVID-19 servicing guidelines were followed. Correct any misrepresentation or improper lien activity, including potential lien removal if the servicer can not demonstrate proper disclosure and authorization.
