Subject Line : Debt Collector Unable to Prove Ownership - Illegal Collection & Credit Reporting I am submitting this complaint regarding CAC FIN XXXX in connection with their attempts to collect on an alleged account that they have failed to validate under federal and state law. The company is furnishing negative information to the credit bureaus and contacting me about a debt they can not legally prove they own or are authorized to collect. Specifically, I submitted a timely request for debt validation under the Fair Debt Collection Practices Act ( FDCPA ), 15 U.S.C. 1692g. In response, the collector failed to provide any of the following critical documents : Proof of ownership of the alleged debt A valid purchase agreement for the CAC FIN XXXX containing my account A complete and unbroken chain of title from the original creditor to themselves A copy of their state bond or license required to collect in TEXAS Without proof of ownership or a chain of title, CAC FIN XXXX has no legal standing to pursue collection, report to credit bureaus, or claim any right to payment. Furthermore, furnishing derogatory credit information under such circumstances constitutes false and misleading representation under 15 U.S.C. 1692e and may also violate the Fair Credit Reporting Act ( FCRA ), 15 U.S.C. 1681s-2 ( b ), for reporting unverifiable or inaccurate information.
