I financed a XXXX XXXX XXXX with Challenge Financial in XX/XX/XXXX. My payments have always been on time ; I have never defaulted. In XXXX ( about the XXXX ) my vehicle experienced a critical fuel-cell system malfunction and became inoperable. I was not able to immediately tow or repair the car, so I parked it on a residential street. There was no abandonment. Several days later, after the local police towed the vehicle for municipal parking enforcement ( trash day ), Challenge Financial took possession of the car without providing any prior notice to me. I was never informed that you planned to repossess it, nor was I given a chance to cure any alleged default. I only found out my car was taken when I went to the police department. Its now been over 60 days and I still do not have a clear explanation of why you are keeping my car. I have not been told how I can retrieve it, if or when it will be repaired, or what you are demanding for its return. Meanwhile, I have incurred significant transportation costs ( XXXX, rental ) because I rely on the car for daily needs, including caring for my young child. I believe this constitutes wrongful repossession and unfair business practices. I demand either the immediate return of my car, or a formal, legally justified plan and timeline for repairs and return plus reimbursement for my out-of-pocket transportation cost.
