XXXX, XXXX XXXX XX/XX/year> Educational Credit Management Corporation ( ECMC ) Treasury XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXXXXXX I am filing a complaint against Educational Credit Management Corporation ( ECMC ). XXXX is attempting to collect an alleged student loan debt that they have never validated and can not prove they legally own. XXXX has repeatedly violated the Fair Credit Reporting Act ( FCRA ), Fair Debt Collection Practices Act ( FDCPA ), Higher Education Act ( HEA ), and XXXX XXXX XXXX using false federal authority to threaten me. XXXX sent me a letter dated XX/XX/year> claiming they would seize federal and state payments through the Treasury XXXX XXXX ( TOP ). ECMC has no legal standing to request IRS or Treasury offset because they have never produced : a signed promissory note a chain of title documentation proving they paid a default claim a legal assignment from the Department of Education proof they are a certified guarantor authorized to use Treasury Offset an accounting explaining the alleged balance of {$82000.00} Despite this, ECMC is threatening federal enforcement actions. FDCPA Violations : XXXX. 809 ( b ) : Failure to XXXX ECMC has never validated the debt despite my disputes. ECMC has not shown certification or proof of guarantor status. This conduct also triggers : 18 U.S.C. 912 false impersonation of federal authority 18 U.S.C. 1001 false statements in a federal matter 26 U.S.C. 7212 ( a ) corrupt obstruction or misuse of IRS processes ECMCs letter is a false federal enforcement threat, and they are using IRS terminology to intimidate me without legal authority.
