I am filing this complaint because PNC Bank improperly denied my dispute involving charges that resulted from misrepresentation. Their investigation was incomplete, their reasoning was incorrect, and I was not given a full explanation of their findings. Timeline of what happened : In XXXX and XXXX, charges totaling ~ {$24000.00} posted to my PNC credit card ( I do not have the exact dates or amounts because I do not have access to these accounts. ) The merchant misrepresented what they were providing. I did not receive what was promised. Merchant claimed to be a medical doctor and it was found out he is not nor has ever been one. I first realized I had been misled on XX/XX/XXXX from reading a XXXX post of others who had been defrauded. I contacted PNC and filed a dispute on XX/XX/XXXX, explaining the misrepresentation and providing details. PNC told me the case was escalated to multiple teams, including XXXX XXXX XXXX. Between XX/XX/XXXX and XX/XX/XXXX, I followed up several times by phone and email. I did not receive timely updates or requests for additional documentation. On XX/XX/XXXX, I was told that PNC denied my claim. PNC gave XXXX reasons for the denial : 1. They were unable to recover the funds from the merchant. 2. I notified them more than 60 days after the charges posted. Why these reasons are improper : ( 1 ) Unable to recover funds is not a valid basis for denial under Regulation Z. Whether PNC can obtain reimbursement from the merchant does not determine my liability. Regulation Z requires a reasonable investigation into whether the charges were valid not a denial based on merchant non-cooperation. ( 2 ) The 60-day rule was misapplied. This was a misrepresentation dispute, and I notified PNC promptly after I discovered the issue. The timeline for reporting misrepresentation is based on the date of discovery, not merely the date the transaction appeared. I had ongoing communications with the merchant and did not know I had been misled until later. PNC did not ask me for documentation to establish the discovery date. Additional concerns : PNC did not provide all documentation or evidence used in their investigation. The investigation appears incomplete, as critical information and my timeline were not reviewed. XXXX XXXX XXXX told me a decision would be made by the end of XXXX, but I received no communication for more than XXXX weeks despite multiple attempts to follow up.
