This is NOT A DUPLICATE COMPLAINT, this is a Supplemental complaint, public documentation and corroborative exhibit, of ongoing predatory lending and debt collection practices by Credit Acceptance Corporation. I certify that all statements herein, are true factual and to the best of my knowledge. I, XXXX XXXX, submit this supplemental complaint to provide additional corroborative documentation of my ongoing dispute with Credit Acceptance Corporation regarding their servicing of my auto loan account ending in XXXX, related to the XXXX XXXX XXXX. This complaint supports and supplements my prior CFPB complaints, including complaint ID XXXX dated XX/XX/XXXX. All of the information described herein, including a formal Demand for Remedy, Redress, and Compensation dated XX/XX/XXXX, and all supporting documentation and evidence, will be sent directly to Credit Acceptance in a package tomorrow, XX/XX/XXXX. This complaint is submitted to serve as corroboration and official record of my direct notice to Credit Acceptance of the violations and demands summarized below. Credit Acceptance states that the contract required 66 consecutive monthly payments of {$440.00}, totaling {$29000.00}, and that I defaulted after one payment. However, I immediately requested a payment arrangement after that first payment, notifying them of difficulties paying and disputing the account, but was refused assistance and told disputes could not be considered if raised more than 30 days after purchase. This refusal to reasonably accommodate early payment difficulties and disputes is a significant failure in servicing. Under New Jersey law and UCC Article 9, while creditors may repossess collateral upon default without advance notice, they are required to provide post-repossession notices of rights to redeem and intent to sell, and to conduct a commercially reasonable sale. Credit Acceptance repossessed my vehicle from an address different from the contract address but failed to prove that statutorily required notices were sent to my correct address. They report ongoing monthly balance changes and interest accrual inconsistent with the disputed and potentially invalid deficiency. Despite formal cease-and-desist requests, Credit Acceptance has continued collection attempts and negative credit reporting, which may violate the Fair Debt Collection Practices Act ( FDCPA ), 15 U.S.C. 1692c, 1692e, and 1692f, as well as applicable XXXX XXXX and XXXX XXXX laws prohibiting deceptive or abusive debt collection practices. Public enforcement actions by the CFPB and XXXX XXXX Attorney General against Credit Acceptance allege predatory auto lending practicessystematic inflation of principal, hidden credit costs, failure to consider ability to repay, and reliance on repossessions and aggressive collectionspatterns reflected in this account. This complaint supplements my XX/XX/XXXX CFPB complaint ID XXXX and formally documents the substantial and continuing violations by Credit Acceptance detailed in the XX/XX/XXXX demand letter and accompanying evidence, which will be delivered directly to Credit Acceptance on XX/XX/XXXX. I request the CFPB to comprehensively investigate these issues and enforce applicable laws to provide the full relief warranted. This is clearly a class action, there are others affected in XXXX XXXX like the XXXX XXXX Case.
