I am filing this complaint regarding SUNBIT ( also reporting as TAB/SUNBIT ) because the account they are reporting on my credit file does not belong to me, was never opened or authorized by me, and is the result of identity theft. I have already filed an FTC Identity Theft Report, notified SUNBIT of the fraud, and disputed the account with the credit bureaus. Despite this, SUNBIT continues to report the account as a collection/charge-off and has refused to delete it, even though they have not provided any original documentation proving that I opened or agreed to this account. This complaint is necessary because XXXX actions violate the Fair Credit Reporting Act ( FCRA ), the Fair Debt Collection Practices Act ( FDCPA ), and federal identity theft protections. SUNBIT has failed to conduct a reasonable investigation, failed to validate ownership of the account, and continues to furnish inaccurate and harmful information to the credit bureaus. I. I DO NOT OWN THE SUNBIT ACCOUNT I want to clearly and unequivocally state that I do not own, recognize, or have any contractual relationship with SUNBIT. I did not apply for financing with SUNBIT, I did not authorize any retail installment loan, and I did not sign any agreement related to SUNBIT or any merchant allegedly associated with this account. Specifically : I did not open a SUNBIT account I did not sign any SUNBIT contract I did not authorize any SUNBIT transaction I did not receive any goods or services financed through SUNBIT I did not agree to repayment terms I did not authorize SUNBIT or any affiliate to access my credit The SUNBIT account currently reporting on my credit file is fraudulent and the result of identity theft. XXXX. HOW I DISCOVERED THE FRAUDULENT SUNBIT ACCOUNT I discovered the SUNBIT account when reviewing my credit reports from XXXX XXXX XXXX XXXX The account appeared as TAB/SUNBIT, showing a derogatory status and reporting a past-due balance. I immediately recognized that this account was not mine because I had never heard of SUNBIT, never applied for their services, and never conducted any business with them. The account showed information that did not match my financial history, spending habits, or credit behavior. The presence of this account raised serious concerns that my personal information had been compromised and used fraudulently. XXXX. I FILED AN FTC IDENTITY THEFT REPORT After confirming that the SUNBIT account was not mine, I took the proper legal steps and filed an FTC Identity Theft Report through IdentityTheft.gov. This report formally documents that I am a victim of identity theft and that the SUNBIT account was opened without my authorization. Under federal law, including FCRA 605B and the FACTA identity theft provisions, once a consumer files an FTC Identity Theft Report, companies like SUNBIT must : Block or remove the fraudulent account Cease reporting inaccurate information Stop collection activity Conduct a heightened, documented investigation Not continue reporting unless original proof of ownership exists Despite receiving notice of my identity theft report, SUNBIT has continued to report the account and has not removed it from my credit file. A reasonable investigation would include : Reviewing my FTC Identity Theft Report Comparing identity information Reviewing the original account-opening documentation Checking for fraud indicators Verifying signatures and authentication data Confirming merchant records Reviewing delivery and activation records SUNBIT did none of this. Instead, they relied on existing data that may itself be fraudulent. This does not meet the legal standard for a reasonable investigation. VI. CONTINUED REPORTING AFTER IDENTITY THEFT IS UNLAWFUL Once SUNBIT was notified that the account resulted from identity theft, they were legally required to either : Provide original proof that I opened the account, or Delete the account from my credit reports SUNBIT did neither. THE SUNBIT ACCOUNT IS CAUSING ONGOING HARM The inaccurate SUNBIT account has caused significant harm, including : Lower credit scores Damage to my credit profile Difficulty obtaining credit Increased interest rates Financial stress and anxiety Time spent disputing fraudulent information Ongoing risk of further identity misuse This harm is unjustified because the account is not mine. XXXX. CREDIT BUREAUS CONTINUED TO REPORT SUNBIT BASED ON SUNBITS INACCURATE VERIFICATION After disputing the SUNBIT account with the credit bureaus, the bureaus responded that the account was verified based on SUNBITs response. However, SUNBIT did not provide any proof to the bureaus that I opened the account. The credit bureaus relied on SUNBITs automated responses instead of requiring actual documentation. This resulted in continued inaccurate reporting and further harm. XXXX. SUNBIT FAILED TO COMPLY WITH IDENTITY THEFT BLOCKING REQUIREMENTS Under FCRA 605B, once a consumer submits an identity theft report, the credit bureaus must block the fraudulent information. SUNBITs refusal to delete the account prevented proper blocking and allowed the account to remain on my credit report. SUNBITs actions undermined the identity theft protections guaranteed by federal law. X. THIS COMPLAINT IS NECESSARY DUE TO SUNBITS REFUSAL TO CORRECT THE ERROR I have taken all reasonable steps to resolve this issue directly with SUNBIT, including : Filing an FTC Identity Theft Report Disputing the account with credit bureaus Notifying SUNBIT that the account is fraudulent Requesting proof of ownership SUNBIT has refused to delete the account or provide proof. As a result, I am seeking CFPB assistance. XXXX. WHAT I AM REQUESTING I am requesting that the CFPB require SUNBIT to : Immediately delete the SUNBIT/TAB-SUNBIT account from all credit bureaus Cease all collection and reporting activity Acknowledge and honor my FTC Identity Theft Report Provide written confirmation that the account will not be reinserted or transferred Correct all inaccurate reporting related to this account If SUNBIT claims the account is valid, they must be required to provide original, signed documentation proving that I opened the account. If they can not, deletion is mandatory. XXXX. CONCLUSION I am a victim of identity theft. I filed an FTC Identity Theft Report. The SUNBIT account reporting on my credit file does not belong to me. SUNBIT has failed to provide proof, failed to conduct a reasonable investigation, and continues to report inaccurate, derogatory information. I respectfully request CFPB intervention to enforce the law and require SUNBIT to remove this fraudulent account from my credit reports.
