Dear CFPB, XXXX XXXXi and West Capital Lending Compliance Office, I am filing a complaint against West Capital Lending and its loan officer, XXXX XXXX, NMLS # : XXXX, located at XXXX XXXX XXXX, XXXX XXXX, XXXX, CA XXXX, for misrepresentation, misleading assurances, and interference with an existing loan transaction, which resulted in financial loss and direct harm. Early in XXXX, another lender had already conditionally approved and processed my home equity loan, for which I had personally paid for the appraisal. During this process, XXXX XXXX contacted me persistently, promising he could offer me a much better deal, including a free appraisal, reimbursement of my already-paid appraisal, and lower rates appropriate for my credit profile ( approximately XXXX ). He also stated that he could beat my existing offer, secure {$30000.00} cash back, and lower my loan costs significantly. He further advised me not to proceed with my current lender and warned that if another company pulled my credit, it could interfere with his loan offer, causing me to pause progress on a valid loan approval I already had. Based on his repeated assurances, I relied on his promises in good faith, provided sensitive financial information, paused my existing loan process, and engaged in several communications regarding loan disclosures and application steps. During this time, he continued to reassure me that he could beat their offer by a fair amount and told me my appraisal would be free or reimbursed. However, despite his repeated claims, he failed to deliver any loan, did not provide a competitive offer, did not reimburse or provide a free appraisal, and ultimately left me without any home equity loan at all, despite being previously approved elsewhere. As a result of these actions, I experienced : Loss of my previously approved loan Financial loss for an appraisal I paid for based on assurances of reimbursement Disrupted financial planning and increased stress Numerous hard inquiries on my credit file Wasted time due to misleading assurances and interference These actions constitute misrepresentation, deceptive practices, and interference with a financial transaction, which I believe violate consumer protection standards.
