I am filing this complaint because Capital One has failed to comply with the Fair Credit Reporting Act ( FCRA ) regarding several fraudulent accounts that are not mine. In XXXX of this year, I submitted a valid FTC Identity Theft Report, a copy of my ID, proof of address, and complete documentation of every fraudulent transaction tied to the affected accounts ( XXXX XXXX and XXXX Capital One accounts ). These accounts were used without my authorization and are now closed, yet they continue to appear on my credit reports. Despite providing all legally required proof, the creditors have refused to assist me and repeatedly sent me in circles ( contact the credit bureau contact the creditor ), resulting in months of non-compliance and no resolution. Under FCRA 605B, once a consumer submits a valid identity theft report, the fraudulent accounts must be blocked within 4 business days. The companies involved have failed to do so. I am requesting immediate enforcement so these fraudulent accounts are permanently blocked and removed from my reports, and that all parties comply with their legal obligations. Please investigate and require Capital One to remove these fraudulent accounts from my credit file immediately. Thank you.
