This letter is a formal dispute and fraud complaint regarding the CarMax Auto Finance account being reported under my name. After reviewing the documents, I confirmed that the buyers signature on the Retail Installment Contract is not my signature, was not written by me, and does not match my legal signature in any capacity. The signature shown on the contract is my full name written out in print. I do not sign my full name on any legal or financial documents. My actual legal signature is shortened, stylized, and completely different from the handwriting on this contract. The handwriting on the contract is printed, not cursive, and does not match my handwriting at all. I did not write it, I did not authorize it, and I did not sign that contract. To support this dispute, I have attached a copy of my drivers license, which contains my real legal signature. The comparison clearly shows that the signature CarMax submitted is forged and not written by me. Because the signature is not mine, the contract is fraudulent, void, and unenforceable. CarMax is furnishing information that is inaccurate, unverified, and can not be supported with a valid, authentic consumer signature. Under FCRA 602, 607 ( b ), 611, FCRA 623, FACTA, Metro 2 reporting standards, and federal forgery laws ( 18 U.S.C. 471473 ), no company may report an account that is not tied to a legitimate consumer-signed contract. I am demanding the following actions : 1. Remove the CarMax Auto Finance account from my credit reports immediately because there is no valid contract associated with my name. 2. Remove all hard inquiries related to this fraudulent account. 3. Provide written proof of validation, including the original wet-ink signature, the full application, identity verification records, and all supporting documents. 4. If you can not produce my true, verifiable signature, the account must be deleted under federal law. 5. Mail the results of your investigation to me within the legally required timeframe. If this matter is not resolved, I will file complaints with the CFPB, the Attorney General, and the FTC for identity misuse, and pursue additional action under FCRA 616617 for damages.
