Consumer Narrative
This is a follow up on my prior dispute and XXXX submission to the CFPB regarding the referenced account. XXXX provided a copy of a signed lease and a deposit disposition. However, these documents do not validate the alleged debt of {$4200.00} as required by the Fair Debt Collection Practices Act ( 15 U.S.C. 1692g ). Specifically, the documentation fails to include : 1. An itemized final account ledger showing all charges and payments, 2. Invoices or receipts supporting any alleged damages or fees, 3. Proof of re-rental or mitigation of loss, as required under Colorado landlord-tenant law, 4. A full accounting demonstrating how the balance of {$4200.00} was calculated. Until XXXX provides complete verification, this debt remains disputed and unvalidated, and you must cease all collection activity and delete any credit reporting immediately. Furthermore, please note : The alleged obligation dates back to 2021, arising from a Colorado lease. Under Colorado Revised Statutes 13-80-101 ( 1 ) ( a ), the statute of limitations for written contracts and lease-related debts is three years. Therefore, this debt is time-barred, and you have no legal right to enforce it in court. The account has already been deleted by XXXX and XXXX, leaving only an inconsistent listing with XXXX, which constitutes inaccurate reporting under the Fair Credit Reporting Act ( 15 U.S.C. 1681s-2 ). Accordingly, I demand that XXXX : Permanently cease all collection efforts ; Instruct XXXX to delete any remaining tradeline ; and Confirm closure of this file in writing.
