Consumer Narrative
I am writing to place Transunion on formal notice of its ongoing noncompliance with the Fair Credit Reporting Act ( FCRA ), 15 U.S.C. 1681 et seq., and to advise you of my intent to pursue legal action if these violations are not promptly corrected and resolved. I have been disputing inaccurate information on my Transunion credit file for nearly two years. Despite multiple written disputes and specific requests for reinvestigation details, Transunion continues to report inaccurate, incomplete, and misleading information regarding several tradelines. As of the date of this letter, XX/XX/XXXX, these same accounts are still being reported inaccurately, and my requests for a meaningful reinvestigation and method-of-verification details have not been honored. Background and Dispute History On XX/XX/XXXX, I sent a written dispute to Transunion identifying inaccuracies and requesting correction and/or deletion of several accounts. In that dispute, I specifically raised the following issues : 1. XXXX XXXX Transunion is reporting this account as a charge-off.- There has been no payment since XXXX, yet the balance and reporting timelines are not properly updated. There are balance discrepancies and a failure to properly update reporting timelines. The payment history is incomplete and inaccurate. I specifically demanded that this tradeline be deleted for outdated and unverifiable reporting. 2. XXXX- The account number reported by Transunion is incomplete, preventing accurate identification and verification of the account. The account status is inaccurate.- The last payment date is inaccurate.- The payment history is inaccurate and incomplete. There are balance discrepancies and a failure to properly update reporting timelines to reflect the true status and activity on the account. I specifically demanded that this tradeline be deleted for outdated and unverifiable reporting. 3. XXXX XXXX Transunion shows this account as an active charge-off with late payments. The account is marked as open and charged-off at the same time, which is internally contradictory and materially misleading. Creditor remarks show a prior dispute, yet the core issues remain uncorrected. The last payment date is incomplete or inaccurate. The payment history is incomplete and inaccurate. I specifically demanded that this tradeline be deleted due to its misleading and unverifiable status. 4. XXXX Bank Transunion shows this account as an active charge-off with late payments. 6.XXXX XXXX Transunion shows this account as an active charge-off with late payments. In response to my XX/XX/XXXX dispute, I received an updated Transunion credit report showing these tradelines as verified or verified and updated. However, the underlying inaccuracies remained, and Transunion did not meaningfully address the specific issues I raised. On XX/XX/XXXX, I sent a second written dispute and formal reinvestigation request to Transunion concerning these same accounts. In that letter, I again disputed the accuracy of the reporting and specifically requested the following, pursuant to the FCRA : 1. The name, address, and telephone number of the party or parties Transunion contacted to verify each disputed item ; 2. A clear explanation of the method used during the reinvestigation ; and 3. The documents or records provided by the data furnishers that Transunion relied on to verify the disputed information. Transunion responded by providing another updated credit report indicating that the accounts were verified or verified and updated, but none of the specific information I requested was provided. Transunion did not : - Identify the furnishers contacted and provide their name, address, and phone number ; - Provide a clear description of the procedures used to determine accuracy ; or Provide the documents or records from the furnishers upon which Transunion claims to rely. FCRA Violations Under 15 U.S.C. 1681e ( b ), TransUnion is required to follow reasonable procedures to assure maximum possible accuracy of the information that it reports. Continuing to report an account as both open and charged-off, accounts with incomplete account numbers, and accounts with inaccurate last payment dates, payment histories, and balances, even after repeated disputes and notice of these specific issues, calls into serious question whether Transunion is complying with 1681e ( b ). Under 15 U.S.C. 1681i ( a ), once a consumer disputes information, Transunion must : - Conduct a reasonable reinvestigation ; - Complete the reinvestigation generally within 30 days ; - Delete or correct any information that is inaccurate, incomplete, or can not be verified ; AND- Provide written notice of the results of the reinvestigation. Furthermore, under 15 U.S.C. 1681i ( a ) ( 6 ) ( B ) ( iii ) and 1681i ( a ) ( 7 ), when requested in writing, Transunion MUST provide : - A description of the procedure used to determine the accuracy and completeness of the disputed information, including the business name and address of any furnisher of information it contacted ; and- The telephone number of such furnisher, if reasonably available. I specifically requested this information in my letter dated XX/XX/XXXX, yet Transunion has failed to provide it, opting instead to send generic verified notations without transparency or meaningful explanation. These actions and omissions constitute negligent and/or willful noncompliance with the FCRA, including but not limited to 15 U.S.C. 1681e ( b ), 1681i ( a ), 1681n, and 1681o.
