XXXX XXXX XXXX received transfer of loan servicing within the last 60-90 days, and is reporting that my XXXX loan payment is 30 days delinquent. Given that today is XX/XX/XXXX, this is physically, mathematically and chronologically impossible. I alerted Experian to the issue and demanded an immediate explanation for how their system can report this. They refused to divulge that information, and told me it would take 30 days under FCRA to fix it. FCRA should not offer blanket immunity to lenders or credit bureaus to make materially false statements about a consumer when the credit bureau has constructive evidence to know that the statements they are making are false. The intent of FCRA to was protect credit bureaus when the information they are receiving from the lenders is merely being relayed, and the bureau can not know if it's accurate or not unless the consumer disputes it. FCRA is not intended to allow defamation, where a credit bureau acts with reckless disregard to material facts. Defamation is defamation, regardless of whether it's fixed within 30 days. I would also argue that making these false statements via the internet would constitute wire fraud, and making them via regular mail would constitute mail fraud. Why should a consumer be forced to bear the burden of losing XXXX points on their score for obviously false and impossible/illogical results as the result of categorically illegal actions by a lender and credit bureaus? Again, I reiterate, how is it possible to be 30 days past due on a payment for a calendar month that we are still in?
