Formal Complaint Regarding Fraudulent Account and Non-Compliance with Court Order. Non-Removal of fraudulent Account Number Tradeline Despite Court judgement. Account Number : XXXX & XXXX Capital One Credit Card Company. Account Number : XXXX & XXXX Statement of the complaint I am writing to file a formal complaint regarding the refusal of Capital one Credit Card company to remove a fraudulent account trade line from my consumer credit reports, despite the matter being resolved in my favor via court judgement. The account listed above was opened fraudulently without my knowledge or consent. This fact was established and confirmed through legal proceedings. I disputed the debt, which resulted in a legal action filed against me in the XXXX XXXX XXXX XXXX of XXXX Georgia on XX/XX/year>. The court issued a judgment, case No. XXXX ruling that I am not responsible for the debt, thereby confirming the fraudulent nature of the account. I have provided Capital one Credit card company with certified copies of the court judgment. Under Fair Credit Reporting Act ( FCRA ), the creditor is obligated to conduct reasonable information and report accurate information. The court judgement unequivocally proves that this account is inaccurate and fraudulent. Despite notification and receipt of judgment, Capital One credit Card Company has refused to delete this tradeline. The continued presence of this negative, fraudulent, and legally invalidated tradeline is causing severe and ongoing damage to my credit profile and is a clear violation of fair credit reporting practices and the sanctity of the court order. I demand the following immediate corrective actions. Immediate and permanent deletion of the trade line for account numbers ending in XXXX & XXXX from all three credit reporting agencies, XXXX XXXX XXXX XXXX A written confirmation of this deletion, including the date the removal was processed.
