Consumer Narrative
On multiple dates I disputed a Discover Bank charge-off account that appears on my credit reports. I submitted disputes through the credit bureaus and sent a written 623 ( a ) ( 3 ) Direct Furnisher Dispute and a Method of Verification ( MOV ) request to Discover by certified mail. I requested verification of the account, including the documentation required under FCRA 609 and 611 ( a ) ( 1 ) : the signed credit agreement, application, or any original contract showing liability, as well as the records relied upon to verify the account. Discover responded with stall letters on multiple dates XX/XX/year> and XX/XX/year>, stating they could not proceed without additional informationeven though the information I requested is information THEY are required to maintain and provide to validate reporting. Which they proved they had, on a letter of XX/XX/year>. They did not provide any of the documentation requested. No signed agreement, no application, no contract, no account-opening records, and no records relied upon by the furnisher were provided. Despite failing to provide verification, Discover continues to report this account as a valid Charge-Off across all three bureaus. This violates FCRA 623 ( a ) ( 3 ), which requires a furnisher to not report information that can not be verified and to conduct a reasonable investigation before verifying disputed information. Additionally, the credit bureaus completed their reinvestigations without Discover providing the method of verification or any supporting evidence, violating FCRA 611 ( a ) ( 7 ). This prevents me from confirming that the furnisher actually verified the account or identifying what documentation was reviewed. Without documentary evidence of ownership, liability, or accuracy, the account can not be legally verified. Discover is reporting a charge-off without being able to produce a contract, agreement, authorization, or verification documents proving the account belongs to me. This constitutes an incomplete and unreasonable investigation under FCRA 611 ( a ) ( 1 ). I am requesting CFPB assistance because Discover has failed to provide legally required verification and continues reporting unverifiable negative information, causing ongoing harm to my creditworthiness. I have attached copies of : The Discover 'stall letters My MOV request My direct furnisher dispute Certified mail receipt and delivery confirmation Credit bureau dispute results Since Di scover has been unable to verify the account with proper documentation, I am requesting that the Discover Bank tradeline be DELETED from all credit bureaus.
