Subject : Request for CFPB Review Avant Mishandling of Valid XX/XX/year> Payment ( Partial Resolution Only ) I am requesting that the CFPB re-open or re-review my complaint ( COMPLAINT ID No. XXXX ) against Avant because the core issue of my disputeremains unresolved, despite Avant partially correcting some items. What Happened : In XX/XX/year>, I accidentally made XXXX payments to Avant : XXXXA payment throughXXXX XXXX XXXX XXXX XXXX XXXX ) XXXXA payment using my * XXXX XXXX debit card XXXX XXXX ( which is attached to a completely different bank entity account ) I immediately contacted Avant and requestedONLYthe XXXX XXXX XXXX payment be refunded. What Remains Unresolved Avant still incorrectly claims : That the XXXX payment was refunded due to my instructions ( XXXX is a complete different entity of a bank as XXXX XXXX XXXX ) That I did not make a valid XX/XX/year> payment That their handling of my payments was correct These statements are factually false. If that were true, Avant would never have : Corrected the credit reporting These actionsonly occur when the lender acknowledges that the reported late payment was incorrect. XXXX actions contradict their written statements and indicate internal acknowledgment of error. ( Yet as of now they still charged me a late fee of XXXX dollars for the month of XXXX incorrectly which I still paid and their continuing to charge these kind of late fees for the next months until I resolve this issue, which is fraud. ) Why CFPB Review Is Needed Avant corrected the surface-level issues but refuses to fix the core problem : They refuse to apply my valid XXXX payment They refuse to correct my internal payment ledger They refuse to remove XXXX late fees for my monthly payments Their written response still contains inaccurate and contradictory claims ( See attached Avant response letter ) Requested CFPB Resolution I respectfully request that the CFPB require Avant to : Reimburse XXXX which I was wrongly charged on my XXXX payment and to not tag it on to future months Apply the XXXX XXXX debit card payment as my valid XX/XX/year> installment Correct their internal payment history to reflect this Provide written confirmation that XX/XX/year> is now properly marked as paid Thank you for your attention. Listed below are a bundle of contradictions located in their letter which is in the attached files Contradiction XXXX XXXX : Avant claims they refunded the XXXX payment. XXXX XXXX refund ever occurred. My statements show no refund returned to my account. A refund can not be missing it either posts or it does not. Contradiction XXXX XXXX XXXX Avant claims the payment was unsuccessful or reversed. XXXX Bank confirms it was fully processed and never reversed. No insufficient funds. Insufficient funds ONLY pertained to XXXX XXXX XXXX, NOT XXXX XXXX No return codes. Contradiction XXXX XXXX : Avant claims I requested BOTH refunds. Emails and call logs show I only requested the XXXX XXXX refund. ( See attachment below ) Contradiction XXXX XXXX XXXX Avant should not correct credit reporting if no payment existed. Avant removed the negative XXXX late payment. ( BUT NOT THE XXXX DOLLAR LATE FEE FOR XXXX, WHICH I PAID ) Avant removed late and NSF fees. ( BUT NOT THE XXXX DOLLAR LATE FEE FOR XXXX, WHICH I PAID ) These actions contradict their statement that no payment was made. Contradiction XXXX XXXX : Avant says receiving bank statements does not prove XXXX payments. The XXXX statementaloneproves a successful payment. XXXX refund claim is disproven by the absence of any returned payment. ( ONLY the XXXX XXXX XXXX reflects a return which is not the issue at hand ) Contradiction XXXX XXXX : Avant refunded a valid payment ( their claim ) but also claims the payment failed. A failed payment can not be refunded. A successful payment must be manually refunded. XXXX statements conflict with each other.
