Consumer Narrative

I am submitting a rebuttal to Affirms response. Affirms explanation is incorrect and does not match the actual events. I have documented proof that : Affirm incorrectly coded my loan ( XXXX ) as included in bankruptcy, This coding error prevented me from making further payments, I contacted Affirm and its servicer multiple times before any payment was ever late, My account was wrongfully closed/charged off while I was actively attempting to pay, Affirm provided misleading information in their response to the CFPB. Case Numbers Showing Early Contact & Attempts to Fix the Issue Before any delinquency occurred, I opened the following support cases with AffirmXXXX : Case # XXXX Case # XXXX Case # XXXX Case # XXXX These cases were all opened in XX/XX/year>, and they show clearly that I informed Affirm that : My loan was not included in bankruptcy, I wanted to continue making regular payments, The account was incorrectly coded as bankruptcy, I was trying to pay but Affirm was refusing/blocking payments. Affirm Refused or Blocked My Payments I made a confirmed payment on XX/XX/year>. After this date, I attempted to continue making payments, but Affirm and XXXX refused or prevented the payments due to their incorrect bankruptcy coding. I have emails and call logs proving that Affirm/XXXX : Closed the account prematurely Refused payments Told me the account was charged off even though no payments were past due Affirms Delinquency Reporting Is Inaccurate Affirm reported that : No further payments were made, and the delinquency was due to my failure to pay. This is false. The delinquency and charge-off were caused by Affirms refusal to accept payments, not by me missing payments. Therefore : The delinquency is inaccurately reported The charge-off is inaccurately reported Affirms response to the CFPB is misleading This violates the Fair Credit Reporting Act ( FCRA ) Requested Resolution I am requesting : Removal of all delinquency and charge-off reporting for loan XXXX Backdating the account to reflect accurate payment history Correction of all reporting to reflect that the delinquency was caused by creditor error A full investigation into why my account was coded as included in bankruptcy Review Affirms misleading statements provided to the CFPB I am prepared to provide emails, call logs, statements, and screenshots confirming my attempts to pay and Affirms refusal to accept payment. Thank you for reopening this investigation.
