Since XX/XX/year> regarding initial complaint against Fortiva Credit Card complaint number XXXX XXXX responded on XX/XX/year> Response Type Closed with monetary relief XXXX 's Response CFPB # XXXX This company went on to use a date of the periodic date of XXXX per month as due date despite acknowledging today the date was changed in mid XXXX to the XXXX of each month. The late fees charged since XX/XX/year> are XX/XX/year> {$41.00}, XX/XX/year> {$41.00}, XX/XX/year> {$41.00} and the payment was made again. The year to date totals changed mulitple times for the fee cap limit law which I understand they define as first year initial credit card limit which does not allow for increased fees after the first year this restricts them from increasing the fees per the intial credit per the understanding. However, they have changed the payment dates, they manipulated the year to date totals to undermine the credit card cap of fees per credit issued. This company refused to provide the bank name which they indicated had reversed a {$99.00} payment posted to my account on their statement due date of XX/XX/year> paid on time and posted per my XXXX closed on XX/XX/year>. They reversed this payment on XX/XX/year> and had already charged a late fee on XX/XX/year> per my statement AGAIN. The bank indicated Fortiva had reversed this payment for {$99.00} stating they had paid it for XXXX minutes and it was reversed out of the account on the XXXX or XXXX of the month. They did not notify me of the reversed payment nor the late free applied per email or mail as of XX/XX/year>. They did not provide any acknowledgment of the late fees throughout the year and did acknowledge the due date was changed internally on the statements without reflecting on the physical statements which did cause the late payments. I did ask for the account to be locked until I can clear this up. I did contact them over the matter. The cap on fees is legal this card is {$650.00} limit, the fees for this card is .54 % for this credit card far exceeding the limit cap and has been charged for over a year. YOU the consumer board failed to correct their error allowing them this right despite the law. These types of predator cards undermine the financial security of ANY CONSUMER. Thank you. I strongly suggest you read their letter and the excuses they used to apply the types of account fees of pawn brokers for XXXX credit. Thank you for your tax paid time. I willl look into lobbying for XXXX taxes on service like yours. XXXX XXXX
