Consumer Narrative

I XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX incorrectly billed us for an XXXX XXXX that was never ordered, never delivered, and never authorized by anyone at our facility. On XX/XX/2024, I sent XXXX XXXX XXXX written dispute informing them that : No equipment was ever delivered No contract or agreement was ever signed The billing was incorrect A refund was requested They must stop invoicing the facility XXXX XXXX never responded to this dispute and continued issuing invoices. Despite failing to provide any validation or response, XXXX XXXX referred this invalid account to SIMM Associates, a third-party debt collector. I received a collection notice on this alleged debt for {$1400.00} ( SIMM Ref # XXXX ). This referral occurred after the debt was already disputed in writing, and after XXXX XXXX failed to offer any validation. Why this is a problem : XXXX XXXX appears to have violated federal law, including : Failing to provide debt validation upon written dispute Continuing to bill after being notified in writing that the charges were invalid Referring the matter to collections despite an unresolved dispute Attempting to collect on a debt without any contract, signature, delivery record, or proof of liability SIMM Associates is now attempting to collect on a debt that : Is not valid Has been previously disputed Has never been substantiated Relates to equipment never delivered or ordered This is causing unnecessary administrative burden and represents improper debt collection practices. What I want resolved : I am requesting that the CFPB require XXXX XXXX XXXX XXXX to : Immediately recall the account from SIMM Associates Cease all billing and collection attempts permanently Provide written confirmation that XXXX XXXX XXXX XXXX does not owe anything Provide a written explanation of how the erroneous billing occurred Issue a refund for any prior incorrect charges that we paid I am also requesting that SIMM Associates : Cease all collection communication XXXX the account as disputed and unvalidated Confirm that no negative credit reporting has been or will be made This is a clear case of improper billing and improper debt collection activity despite prior dispute. Entities involved : XXXX XXXX XXXX XXXX. SIMM Associates , Inc. ( debt collector ) Attachments I will upload : Copy of my original dispute letter to XXXX XXXX XXXX dated XX/XX/2024 ) Copy of the collection notice from SIMM Associates
