Consumer Narrative

This complaint is about inaccurate and unlawful reporting by both Comenity Capital Bank and XXXX XXXX XXXX. The account status being reported can not be verified, is contradictory, and violates FCRA 611, 623, and XXXX XXXX reporting requirements. 1. XXXX XXXX XXXX admitted TWICE that they acquired the account and later deleted their tradeline. On XX/XX/XXXX, XXXX stated they acquired the XXXXComenity account, verified the debt, and later terminated collection efforts and sent deletion requests to the credit bureaus. This matches XXXX update between XX/XX/XXXX and XX/XX/XXXX, confirming the XXXX XXXX collection was removed. 2. On XX/XX/XXXX, XXXX submitted a second response claiming that the complaint seems to be regarding the original creditor, contradicting their first admission. These contradictions make the account unverifiable under FCRA 611 ( a ). 3. Comenity Capital Bank admitted on XX/XX/XXXX that : They are no longer the creditor They sold the account on XX/XX/XXXX to XXXX XXXX XXXX They reported a {$0.00} balance owed Despite this, Comenity continues to : Report a current charge-off Update the tradeline monthly Verify the account during disputes Refuse deletion A sold account can not be legally updated, verified, or reported as a new charge-off. This violates FCRA 623 ( a ) ( 1 ) ( A ) and XXXX XXXX Sold Account guidelines. 4. Reinsertion violations : After XXXX deleted their tradeline, no credit bureau issued an FCRA 611 ( a ) ( 5 ) ( B ) reinsertion notice. This is a federal violation. 5. Reporting now conflicts between both companies : Comenity claims they no longer own the account. XXXX claims they acquired, verified, and then deleted it. Comenity continues to report derogatory information. The information can not be verified by either furnisher. Under FCRA 611 ( a ) ( 1 ) ( 5 ), unverifiable or contradictory information must be deleted. Requested Resolution : I am requesting the CFPB to : Order Comenity Capital Bank to delete the entire tradeline from all credit bureaus Confirm XXXX XXXX deletion remains removed Address the reinsertion violations Enforce FCRA 611, 623 and XXXX XXXX reporting requirements The account can not be legally reported or verified and must be permanently deleted.
