Santander Consumer USA is illegally reporting a repossession and a charged-off deficiency balance on my credit reports, even though they did not comply with Illinois XXXX XXXX laws or the Fair Credit Reporting Act. I did not receive the XXXX legally required notices under Illinois law ( XXXX ILCS XXXX, XXXX, and XXXX ). I did NOT receive a Notice of Intent to Repossess ( Right-to-Cure letter ) and I did NOT receive a Post-Sale Notice of Deficiency after the vehicle was repossessed and sold. Without these notices, the deficiency balance is legally zero and unenforceable. A lender may not report or collect a deficiency when the statutory notices were not provided. Despite this, Santander is furnishing inaccurate information to the credit bureaus by reporting a repossession and an unpaid charged-off balance. This violates FCRA requirements for accuracy and reliability. It is inaccurate to report a deficiency balance when the deficiency is legally invalid. Additionally, the address Santander used for the account does not match the identifying information in my XXXX credit file. Because the address does not appear anywhere in my current or prior address history, the account can not be properly matched to my identity and is therefore unverifiable under FCRA requirements.
