Consumer Narrative
I am filing a complaint against my student loan servicer for inaccurate credit reporting and failure to properly investigate my dispute. There are several clear inaccuracies in the way my payment history is being reported. According to the payment grid on my credit report, the servicer shows long stretches of XXXX ( on-time ) payments, then suddenly marks the account as XXXX days late and XXXX days late, and then immediately returns to XXXX. This pattern is inconsistent with standard federal reporting. Normally, delinquency progresses in XXXX increments ( XXXX XXXX XXXX XXXX ). My report shows no XXXX or XXXX lates, which is highly unusual and suggests inaccurate reporting. Additionally, the same exact XXXX and XXXX late months are duplicated on multiple account rows, which suggests that the same delinquency is being reported twice for different account numbers. This is causing duplicate derogatory marks and artificially lowering my credit score. There also appears to be inconsistent sequencing, with lates being reported even though the months directly before and after them are listed as XXXX. This does not logically or legally align with how payment delinquency is supposed to be tracked or reported. Under 15 USC 1666 ( b ), I am exercising my right to dispute any billing or account information that is inaccurate or misapplied. I previously requested verification and documentation for these late payments, yet the servicer failed to provide accurate records or correct the disputed information. Under 15 USC 1681 ( n ) of the Fair Credit Reporting Act, furnishers and credit reporting agencies may be held liable for willful non-compliance when they fail to correct or investigate inaccurate information
