Consumer Narrative

I am filing a complaint regarding my auto loan with Credit Acceptance for a vehicle purchased from XXXX XXXX XXXX located in XXXX XXXX XXXX, Florida on XXXX XXXX XXXX. The dealership engaged in material misrepresentation, concealment of mechanical defects, unsafe vehicle sale, and unprofessional conduct, all of which directly impact my financed loan. 1. Concealed Check Engine Light at Time of Sale At the time of purchase, the check engine light was blocked by a plastic stick built in near the windshield washer spray arm, preventing me from seeing the warning. The light was on the same night got it checked and turned off and again the next day it was on again, proving the defect existed before I signed the contract and was not disclosed. 2. Misleading Statements by Dealership Staff When I returned to the dealership Monday afternoon ( the next day ) to pick up paperwork, I informed the sales representative. He told me the warning light was normal for a car with XXXX miles, which is false and misleading. This was said inside XXXX XXXX XXXX office, while I was requesting my receipt and paperwork. 3. Independent Mechanic Inspection and Undisclosed Repairs ( {$2400.00} ) That same Monday at XXXX XXXX after dealership visit I took the vehicle to XXXX XXXX XXXX XXXX XXXX located at XXXX XXXX XXXX XXXX, XXXX XXXX, FL for a full diagnostic. They found major undisclosed defects, including : Brake booster Master cylinder Brake pads Tune-up Ignition coils Fuel pressure sensor Multiple motor mounts Total approved repairs : {$2400.00} ( There were additional issues, but my approved amount only covered that much. ) These defects prove the vehicle was unsafe, not road-ready, and misrepresented at the time of sale. 4. Serious Safety Problems Tires Worn to Metal Photos from the mechanic show the tires were dangerously worn, with metal showing, according to the licensed mechanics statement. This vehicle should never have been sold in that condition. 5. Dealership Interference & Tow Truck Attempt While my mechanic had the vehicle, XXXX XXXX XXXX attempted to send their tow truck to take my vehicle, even though my mechanic was already authorized and performing repairs. I gave the dealership my mechanics shop number. I heard them look it up over the phone. As soon as I confirmed my mechanic was actively repairing the car, they mentioned how they cant help but I know towing is extra coming from dealership i said unfortunately no but we can talk about editing this contract and they hung up on me. This attempt to seize the vehicle was unjustified and aggressive. 6. Management Hung Up on Me Repeatedly ( 3 Times ) I made three separate calls requesting to speak with : The finance department The XXXX The dealership owner When I finally reached the owner and politely asked for : Dealer fee renegotiation OR Assistance with repair costs He hung up on me all 3 times. There was no attempt to resolve the issue, communicate, or provide information. 7. Why This Impacts the Lender ( Credit Acceptance ) I signed my loan contract based on representations the dealership made : That the vehicle was in good condition That no major repairs were needed That the check engine light was not on That the car was safe to drive All of these statements were false, and the dealership concealed defects that materially affect the value, safety, and condition of the financed vehicle. This impacts : My loan terms The value of the financed collateral My financial obligations My credit My rights under the finance agreement 8. What I Am Requesting from the Lender ( Credit Acceptance ) Given the dealerships misconduct, I am requesting lender support with : Title status confirmation My rights when a financed vehicle is misrepresented Contract correction or unwind options Pause or protection from negative credit reporting during investigation Guidance on dispute resolution under federal lending rules I am not refusing to pay I am asking for lawful assistance because the seller engaged in deception that affects the financed loan. 9. Documentation Available I can provide : Photos of the blocked check engine light Photos of unsafe tire wear with metal visible Repair invoice ( {$2400.00} ) Mechanic diagnosis Sales contract Merchant receipt Call logs Statements made by the dealership Full timeline of events I am prepared to upload every document upon request.
