Consumer Narrative

Pulled from LexisNexis credit profile dated XX/XX/year>XXXX This is my fourth complaint regarding LexisNexis Risk Solutions. I am requesting escalation and supervisory action due to repeated violations of the Fair Credit Reporting Act ( FCRA ) and LexisNexiss ongoing failure to honor my opt-out request and continued improper use and distribution of my consumer report. 1. Improper Use of My Consumer Report After Opt-Out On XX/XX/year>, I submitted an opt-out request to LexisNexis and received written confirmation that my data would be suppressed. Despite this : LexisNexis continues to share and furnish my personal information I continue receiving financial/insurance offers linked to LexisNexis data My information is still accessible in LexisNexis products LexisNexis continues distributing my identity data and public records This violates : FCRA 1681b ( permissible purpose ) LexisNexiss own suppression/opt-out policies Consumer privacy protections under the GrammLeachBliley Act ( GLBA ) This is an ongoing violation, not a resolved issue. 2. Bankruptcy Verified Through XXXX Unverified Under the FCRA LexisNexis lists a bankruptcy with the source : XXXX XXXX XXXX XXXX : is not the furnisher of the record is not the court clerk is not the custodian of the official record is not responsible for accuracy XXXX itself warns it is not the official court record. Therefore, LexisNexis has violated : FCRA 1681e ( b ) failure to ensure maximum possible accuracy FCRA 1681i ( a ) failure to conduct a meaningful reinvestigation Because LexisNexis did not verify this information with the actual court/furnisher, the bankruptcy is unverified as defined under 1681i ( a ) ( 5 ) and must be deleted. The continued reporting of unverified public records after an opt-out is especially harmful and unlawful. 3. Identity Mismatches and Ongoing Harm LexisNexis continues reporting : Inaccurate name variations ( e.g., Inaccurate and outdated addresses A masked DOB that does not match the full public-record DOB These mismatches demonstrate faulty identity linking and a violation of FCRA 1681e ( b ). This causes real, measurable harm, including : Incorrect association with a bankruptcy Ongoing privacy breaches Denials or adverse decisions on financial offers Emotional and reputational harm This harm is continuing because LexisNexis refuses to correct the data. 4. Pattern of Willful Noncompliance I have filed three previous CFPB complaints, and LexisNexis continues to respond with : Template, copy-and-paste responses No meaningful documentation No verification from the furnisher ( the bankruptcy court ) No explanation for ignoring my opt-out No correction of inaccurate identity information This pattern suggests willful and negligent violations under : FCRA 1681n ( willful noncompliance ) FCRA 1681o ( negligent noncompliance ) 5. False Statement Regarding PACER ( Attached Letter ) LexisNexis provided a response that is legally inaccurate and misleading. I am attaching the letter they sent me so the CFPB can review their wording directly. LexisNexis stated : XXXX is the system of record for bankruptcies. This statement is factually false and contradicts the Federal Judiciarys own published guidance. XXXX is not the system of record, is not the official court record, and is not a furnisher of information under the FCRA. XXXX is simply a public-access tool with no responsibility for accuracy or identity verification. The official record is held by the U.S. Bankruptcy Court Clerk, who is the actual furnisher of informationnot XXXX. Because LexisNexis used XXXX instead of contacting the courthouse : They violated FCRA 1681e ( b ) ( failure to ensure maximum possible accuracy ) They violated FCRA 1681i ( a ) ( failure to conduct a meaningful reinvestigation ) They failed to verify the bankruptcy with the furnisher, as required They have admitted to relying on an unverified secondary database They provided misleading and deceptive information in their response Under 1681i ( a ) ( 5 ) ( A ), if a CRA can not verify information with the furnisher, the information must be deleted.
