Complaint Against : Resurgent Capital Services/ LVNV Funding LLC Summary of Issue : I requested a Debt Validation from Resurgent Capital Services on XX/XX/year>, regarding an alleged debt they claim to own on behalf of LVNV Funding LLC. I also sent a Cease & Desist notice. On XX/XX/year>, they responded only with a basic account summary. They failed to provide : Any documentation proving XXXX owns the debt Chain of assignment from the original creditor ( XXXXXXXX XXXX ) ( XXXX XXXX XXXX ) ( XXXX XXXX ) Original signed agreement or contract Itemized balance breakdown Billing statements Proof of the accuracy of the amount Under 15 U.S.C. 1692g ( b ), a debt collector must cease collection until proper validation is provided. Resurgent did not provide adequate validation and keeps the account open in collection status.
