I am reporting multiple fraudulent Affirm loans that were created as the result of identity theft. These loans do not belong to me, and I did not authorize, open, or use any of them. The fraudulent Affirm loans that have appeared under my identity include the following : XXXX Loan ID XXXX XXXX XXXX Loan ID XXXX XXXX XXXX ID XXXX Lamps Plus Loan ID XXXX These accounts began appearing on my credit reports even though I did not create an Affirm account, and I never opened any accounts with any of the merchants above. I filed identity-theft reports with multiple federal agencies, including an FTC Identity XXXX Report, an FBI XXXX report, and a XXXX XXXX XXXX XXXX report. I also disputed these accounts with all three major credit reporting agencies and mailed dispute packets directly to Affirm through certified mail. Despite this, Affirm continued to furnish these fraudulent loans to the credit bureaus, continued verifying them as accurate, and failed to block the identity-theft information as required by FCRA section 605B. Affirm did not respond appropriately to my disputes and did not conduct a reasonable investigation under FCRA section 611. They repeatedly verified the fraudulent XXXX Affirm loan as accurate between XXXX and XXXX, even after they had been notified that the accounts were the result of identity theft. Affirm then transferred the fraudulent XXXX loan to XXXX, a third-party debt collector, and I received a collection notice from XXXX on XX/XX/XXXX. This happened after Affirm had already received my identity-theft reports and multiple disputes. Transferring a known fraudulent account to collections caused additional harm and violates FDCPA requirements for debt XXXX and FCRA obligations for furnishers. Affirms internal process for reporting unauthorized activity requires logging into an Affirm account, but I do not have an Affirm account and can not log into an account created by an identity thief. This makes it impossible for me to use their process and prevents me from exercising my rights under federal law. Affirm has made no effort to offer an alternative method for identity-theft victims, and instead relies on a system that blocks victims from submitting required information. As a result of Affirms failure to block or delete these fraudulent accounts, failure to reasonably investigate, failure to respond appropriately to identity-theft reports, and transferring a fraudulent account to collections, I have suffered significant financial harm. This includes credit score damage, increased insurance premiums, higher interest rates, loan denials, and other negative financial impacts. I am requesting that the CFPB require Affirm to comply with FCRA identity-theft protections, delete all fraudulent Affirm loans, recall any accounts sent to collections, remove all related inquiries, and correct all information furnished to the credit bureaus. I also request that the CFPB escalate this matter due to the pattern of violations and the ongoing financial harm.
