CFPB Complaint Shellpoint Mortgage Servicing Loan Number : XXXX Borrower : XXXX XXXX XXXX XXXX Address : XXXX XXXX XXXX, XXXX, FL XXXX I am requesting an immediate investigation into the servicing actions taken by Shellpoint Mortgage Servicing while they were the servicer of my FHA-insured mortgage. My loan originated as an FHA loan through XXXX XXXX XXXX and was transferred to Shellpoint as an FHA-insured loan. During Shellpoints servicing period, the loan was converted from FHA to a Conventional product through a loan modification, without a refinance, without FHA-required procedures, After making this unauthorized loan conversion, Shellpoint then transferred the loan to XXXX XXXX , creating confusion, inaccurate loan status changes, and possible violations of FHA servicing guidelines and federal mortgage-servicing law. These actions appear to violate : HUD Handbook 4000.1 ( FHA servicing and loss-mitigation requirements ) 12 C.F.R. 1024.35 Servicing Errors 12 C.F.R. 1024.36 Requests for Information FHA case-transfer and investor-type rules A formal complaint has also been filed with HUD for investigation into the unauthorized FHA-to-Conventional conversion and the loan transfer sequence. I am requesting : 1. A full investigation into Shellpoints handling, modification, and transfer of my loan. 2. All documentation showing how and why Shellpoint converted my FHA loan to Conventional. 3. All FHA case history and investor type records during Shellpoints servicing period. 4. Correction of any inaccurate or unauthorized actions taken on the loan. I am the sole borrower on this mortgage and fully authorized to receive all servicing information related to my loan.
