I am formally disputing the collection account being reported by OPORTUN/XXXX XXXX, which does not belong to me and appears to be the result of identity theft. This account is inaccurate, unverifiable, and being reported in violation of the Fair Credit Reporting Act ( FCRA ), 15 U.S.C. 1681 et seq. On XX/XX/XXXX, I contacted OPORTUN/XXXX XXXX and requested validation of the alleged debt, including : Documentation bearing my wet-ink signature that allegedly authorized or initiated this account ; Verification of their legal right to collect, as required under the FCRA and the Fair Debt Collection Practices Act ( FDCPA ). To date, no documentation or verification has been provided. Under the FCRA : 15 U.S.C. 168li ( a ) requires consumer reporting agencies ( CRAs ) to conduct a reasonable investigation when a consumer disputes the accuracy of information. 15 U.S.C. 1681s-2 ( a ) prohibits furnishers ( such as collection agencies ) from reporting information they know or should know is inaccurate. 15 U.S.C. 1681s-2 ( b ) requires furnishers to conduct an investigation and provide verification once a dispute is received from a CRA. 15 U.S.C. 1681c-2 ( Section 605B ) provides consumers the right to block information resulting from identity theft.
