Consumer Narrative

This is a supplemental complaint with new information and evidence. I previously disputed an alleged XXXX personal line of credit account for {$22000.00} and requested full validation from the collecting company under 15 U.S.C. 1692g ( b ). The collector never provided any of the required documentation : no original signed contract, no itemized accounting, no chain of assignment, no proof of legal ownership, and no documentation verifying that the debt is valid and legally collectible. Instead of providing validation, the company had XXXX send me a generic credit reporting accuracy letter dated XX/XX/year>. That letter only repeats what XXXX historically reported to the credit bureaus. It does NOT validate the debt, does NOT address my dispute points, and does NOT satisfy the debt collectors legal obligations under the FDCPA. Only the debt collector can provide validation, not the original creditor. New evidence : XXXX continues to report inconsistent and inaccurate information. The XXXX tradeline shows a full balance of {$22000.00}, while the related XXXX tradeline shows Closed with a {$0.00} balance. This indicates materially inaccurate reporting under FCRA 1681s-2 ( b ), which was not addressed. Additionally, after I disputed the debt, the collector emailed me an unsolicited settlement offer for the same account. They offered to settle the alleged {$22000.00} balance for {$5600.00} before XX/XX/year>. This communication was sent AFTER my dispute and BEFORE validation was provided. Under 15 U.S.C. 1692g ( b ), all collection activity must cease until the collector provides validation. A settlement offer, discount, payment deadline, and balance demand clearly constitute continued collection activity in violation of federal law. The email also misrepresented the debt by labeling it a XXXX XXXX, which does not match how the tradeline appears on my credit report ( XXXX ). Misstating or altering the name or nature of the debt is a violation of 15 U.S.C. 1692e for false, deceptive, or misleading representations. The collector continued collection efforts, quoted the alleged balance, pushed for payment, and sent a payment link all before validating the debt and in direct violation of the FDCPA. No contract, no chain of title, no proof of authorization from XXXX, and no legally required validation has been provided. The companys actions failed to resolve the dispute, did not validate the debt, and did not correct the inaccurate and inconsistent reporting. I am requesting that the CFPB reopen and escalate this matter, require proper legal validation from the collecting company, address the inaccurate XXXX reporting, and order deletion of the account entirely if validation can not be produced.
