I canceled XXXX XXXX XXXXs connected to my Santander Consumer USA auto loan. One refund check was sent to me. The second refund was never received. I have been following up and requesting a reissual of the second check with Santander Consumer USA customer service for more then 6 months. Santander Consumer USA now ( after months of follow up ) claims the missing refund check was cashed in XX/XX/year>, but they can not tell me who cashed it or bank that processed check. I requested the check image. The back of the check shows no endorsement, no signature, and no bank stamp, meaning the check could not have been legally deposited or cashed. All I can see is a big number. Santander Consumer USA refuses to reissue the refund and told me to work with the bank. However, Santander Bank says they can not help because I do not have an account with them. As the payee, I can not dispute the deposit directly. Only the issuer or the drawee bank can file a forged endorsement or improper payment claim. I have also requested Santander Consumer USA to dispute the check, they deny saying they can not and blame me. They say they sent it to the right address and they are not responsible. I am owed this refund and Santander Consumer USA is responsible for initiating the correct dispute process but refuses to do so. I am requesting CFPB assistance so Santander properly investigates and returns the funds.
