I am filing this new complaint because Bank of New York Mellon and its servicer XXXX XXXX XXXX ( XXXX XXXX ) are committing systematic fraud on the CFPB consumer complaint process by submitting identical, copy-and-paste, completely non-responsive form letters to multiple legitimate complaints so that the CFPB will close the XXXX without any real investigation. In the last XXXX hours ( XX/XX/XXXX ), XXXX XXXX submitted the exact same meaningless letter to at least XXXX separate complaints I filed on the same loan on XX/XX/XXXX : Complaint # XXXX Complaint # XXXX Both complaints were immediately closed the same day the worthless letter was uploaded. The XX/XX/XXXX response is word-for-word identical in both cases, contains the same typos, the same irrelevant boilerplate about the Master Servicer, and does not address a single specific allegation I made ( unexplained $ XXXX principal balance inflation, fraudulent late assignment into a XXXX securitization trust, ignored Qualified Written Requests, dual-tracking, etc. ). This is not an isolated incident. I have received this exact same copy-paste letter more than XXXX times across multiple CFPB complaints dating back months. XXXX XXXX has XXXX the CFPB portal XXXX flooding it with garbage responses that allow the CFPBs system to auto-close complaints without any human review of adequacy. This practice defeats the entire purpose of the Consumer Financial Protection Bureau and violates the spirit if not the letter of the Consumer Financial Protection Act. It is deliberate consumer abuse and deception of a federal agency. As a direct result of these fraudulent tactics, my family faces foreclosure sale of our home on XX/XX/XXXX right after XXXX because the servicer refuses to follow RESPA, refuses to provide lawful accounting, and now refuses to even pretend to answer CFPB complaints.
