I am filing this complaint because XXXX XXXX XXXX ( XXXX ) has continued collection activity, threats of enforcement, and attempts to enforce an invalid security interest, despite receiving a formal written Cease and Desist Notice. The account itself stems from a fraudulent auto sale, and XXXX XXXX is legally liable as the assignee of that fraudulent retail installment contract. Under FDCPA ( 15 U.S.C. 1692c ( c ) ), once a cease and desist is issued, a creditor/collector may not continue : Collection calls Threats Deficiency attempts Repossession threats Enforcement attempts XXXX violated this rule by continuing to process or attempt collection after notice was legally served. B.
