I sent formal written debt validation requests beginning in XX/XX/year> and again on XX/XX/year> regarding multiple alleged XXXX XXXX accounts. Zwicker & Associates responded only with photocopies of billing statements and a generic cardmember agreement. This does NOT meet the legal standards for validation under FDCPA 1692g ( b ) because they failed to provide : Proof of account ownership or assignment Chain of title documentation Sworn custodian affidavit Evidence of lawful standing to sue Despite failing to validate, Zwicker continued collection activity by attempting service of a lawsuit at my residence. This is a direct violation of FDCPA 1692g ( b ). In addition, I have received repeated automated text messages related to these accounts from XXXX XXXX XXXX XXXX Investments, despite my disputes and lack of consent, constituting further violations of FDCPA and TCPA. I notified all parties multiple times that their validation was deficient and that the statutory collection freeze remained in effect. Despite XXXX written notices, collection attempts continue. I am requesting the Consumer Financial Protection Bureau require : Immediate cessation of all collection activity Confirmation of legal standing and validation compliance Deletion of all inaccurate credit reporting Investigation for FDCPA and XXXX violations These actions reflect willful noncompliance with federal consumer protection laws.
