My mortgage was originated by XXXX XXXX XXXX on XX/XX/year> and is currently serviced by RoundPoint Mortgage Servicing. The fully executed Promissory Note from closing shows three borrowers : myself ( XXXX XXXX ), my wife ( XXXX XXXX ), and my brother in law ( XXXX XXXX XXXX ). All three of us signed the note as borrowers. RoundPoint has provided inconsistent and incorrect information about our loan for several days. Multiple RoundPoint representatives told me that only two borrowers were on the loan and that my brother in law was not part of the mortgage. After four calls, RoundPoint finally acknowledged that all three of us are in fact on the loan and that all three of us had a late payment reported to the credit bureaus. RoundPoint also had the wrong phone number on file. This prevented proper delinquency notifications from reaching us. Neither my wife nor I received any valid notice prior to the reported late payment. My brother in law did not receive any notice either. Because all three of us are borrowers, the servicer had a responsibility to notify all parties, and this did not happen. The failure to notify us, the incorrect borrower information provided repeatedly, and the confusion inside RoundPoint created a servicing error that directly led to the negative credit reporting. The balance was paid immediately once we learned of the issue. I am requesting that CFPB review this matter, and that RoundPoint remove or suppress the derogatory credit reporting for all borrowers because the late reporting resulted from servicing errors, incorrect borrower handling, and failure to notify all responsible parties. I have documentation including the signed Promissory Note that confirms all three borrowers. I am attaching that with this complaint.
