Consumer Narrative
A collection account appeared on my consumer report in XX/XX/XXXX under the name Hillcrest Davidson and Associates. The account showed a balance of XXXX dollars and listed XXXX XXXX XXXX at XXXX XXXX XXXX, XXXX, Texas XXXX. I have no knowledge of this account and no record of any agreement with this company. I did not contact the collector. They contacted me several times by phone. I told the representative each time that I do not owe this debt. The representative became hostile during the calls. He stated that the account would stay on my credit report if I did not pay the full amount. He also stated that the company was a law firm. I believe this was false and intended to pressure me. They called me three to four times each day. I never received validation. Under the Fair Debt Collection Practices Act, 15 U.S.C. Section 1692g, a collector must give written validation when a consumer disputes a debt. This includes the amount of the debt, the name of the original creditor, and documentation with a signature if the alleged contract is based on an agreement. I also requested documents that contained my signature and any document with my Social Security number. I did not receive any documents. The collector did not prove that I was the person connected to the alleged account. Under the Fair Credit Reporting Act, 15 U.S.C. Section 1681s-2, a furnisher must report accurate information. If the furnisher can not verify the account, the furnisher must correct or delete the information. The collector continued to report the account each month through XXXX without proper verification. The collector did not confirm that they had my full identifying information. I have no record of any account with this company. Relevant legal cases XXXX XXXX XXXX, XXXX XXXX XXXX ( XXXX. XXXX XXXX. XXXX ) The court held that a collector must provide detailed validation and can not continue collection activity without it. A simple statement of balance is not enough. XXXX v. XXXX, XXXX and XXXX, XXXX XXXX XXXX ( XXXX Cir. XXXX ) The court found that false claims of attorney involvement violate the FDCPA. This applies when a collector states or implies that it is a law firm without proper basis. XXXX XXXX XXXX, XXXX XXXX XXXX ( XXXX Cir. XXXX ) The court ruled that any false suggestion of legal authority or attorney review violates 15 U.S.C. Section 1692e. XXXX XXXX XXXX, XXXX, XXXX and XXXX, XXXX, XXXX XXXX XXXX ( XXXX XXXX. XXXX ) The court ruled that collectors must provide validation that includes more than a balance summary. They must provide documents that prove the consumer is connected to the alleged debt. XXXX v. XXXX XXXX and XXXX XXXX, XXXX XXXX XXXX ( XXXX Cir. XXXX ) The court held that collectors must stop all collection activity until they provide sufficient validation. Legal terminology related to this situation Failure to Validate : The collector did not provide written proof of the debt, which is required under 15 U.S.C. Section 1692g. False Representation : The collector claimed to be a law firm. This is prohibited under 15 U.S.C. Section 1692e. Harassment : Repeated calls intended to pressure payment violate 15 U.S.C. Section 1692d. Unverified Furnishing : Reporting an account without confirming accuracy violates 15 U.S.C. Section 1681s-2 ( a ). Inaccurate Reporting : The furnisher reported an account without proof that I was the correct consumer.
