The underlying loan, originally issued through XXXX in XXXX, was paid in full via a cashiers check for {$11000.00}, which XXXX negotiated. Nevertheless, ECMC has issued a letter dated XX/XX/XXXX, claiming {$38000.00} is owed and asserting intent to collect through Treasury Offset, despite lacking any proof of an unpaid balance. This is a classic instance of zombie debt collection and represents multiple violations of the FDCPA and Treasury Offset regulations. I request that the CFPB require ECMC to : Produce full legal validation, or Withdraw all collection and offset claims, and Correct any internal or federal reporting regarding this nonexistent debt.
