Consumer Narrative
Summary : A lender ( CrossCountry Mortgage, Loan XXXX : XXXX XXXX ) initiated an FHA case number and ordered an FHA XXXX on my property without authorization, without a valid FHA loan application, and without proper borrower identity or disclosures. This unauthorized appraisal is now interfering with my current real estate transaction. What happened : I was the seller in a transaction where the buyer ( XXXX XXXX ) was applying for a XXXX XXXX only. The signed contract did not authorize FHA financing. Despite this, XXXX Mortgage pulled FHA Case Number XXXX and ordered an FHA XXXX in XXXX without my knowledge, approval, or any XXXX documentation being signed. I was not informed that an FHA XXXX was being ordered, and I never signed any FHA disclosures or authorization. Borrower identity problems : The lender told me the buyer did not qualify alone and needed additional co-borrowers ( his daughters ). However, the FHA case number lists only XXXX XXXX, even though he could not qualify alone and even though the executed contract included his wife as a buyer. This does not meet FHA requirements for case assignment or borrower identity. Contract mismatch : HUD requires a valid purchase agreement signed by all actual borrowers. The FHA case number was assigned despite the borrower group on the case not matching the contract and despite the required borrowers not being included. Unauthorized appraisal : The FHA XXXX was completed even though there was no FHA application, no borrower authorization, and no FHA financing approved in the contract. Impact on my current transaction : I have a new FHA buyer at {$460000.00}, but their lender informed me that XXXX Mortgage stated the previous unauthorized {$450000.00} FHA XXXX must be used. This is incorrect and is interfering with my current sale. Lender has not responded : I requested documentation from XXXX Mortgage regarding : FHA application Disclosures Borrower authorization Appraisal order Case number assignment I have received no response. What I believe is wrong : Unauthorized initiation of an FHA case number Unauthorized FHA appraisal Borrower identity misrepresentation Failure to follow HUD XXXX rules Failure to provide required disclosures Interference with a current real estate transaction Lack of lender response to reasonable consumer inquiries What I want : I would like the CFPB to review the lenders conduct and require : XXXX. A written response and explanation. XXXX. Documentation supporting the FHA case number and appraisal. 3. Disclosure of how and why an FHA appraisal was ordered on a Conventional-only contract. XXXX. Correction of the FHA case/appraisal if it was improperly ordered. I can provide documentation upon request.
