issue : illegal credit reporting - debt collector re-aged an account and reported false delinquency dates. Description ( full complaint ) : i am filing a complain against Kimball , Tirey & St. John LLP for illegally re-aging a debt and furnishing false credit information, in violation of the Fair Credit Reporting Act ( FCRA ) and the California Fair Credit Reporting Act ( CFCRA ). My last payment on the underlying debt was in XX/XX/XXXX, and per FCRA 623 ( a ) ( 5 ), this date can not legally be changed by any subsequent collector or debt buyer. However, XXXX, XXXX & XXXX XXXX is reporting the account on my credit report with the following incorrect individual responsibility and inaccurate and impossible dates : Date opened : XX/XX/XXXX First delinquency : XX/XX/XXXX Account Type : Individual Debt This was a joint lease with two other co-signers. Reporting this account as an individual debt violates FCRA 607 ( b ) and 623 ( a ) ( 1 ), as the credit report does not accurately reflect the contractual responsibility. These dates are factually incorrect and do not match the true history of the account. This is a clear case of unlawful re-aging, which falsely makes the debt appear newer, damages my credit score, and improperly extends the reporting period far beyond the legal XXXX limit tied to the original XXXX delinquency. This violates multiple provisions of federal and state law, including : FCRA 607 ( B ) - failure to report with maximum possible accuracy FCRA 623 ( A ) ( 1 ) - furnishing information known or believed to be inaccurate FCRA 623 ( A ) ( 5 ) - reporting an incorrect date of first delinquency California CCRAA and Rosenthal Act Additionally, i have disputed this account twice with the credit bureaus, and XXXX, XXXX & XXXX XXXX verified the same false dates both times. This indicates they are knowingly providing inaccurate information and failing to conduct a proper investigation, which is a willful violation of FCRA 623 ( a ) ( 1 ) and 623 ( a ) ( 5 ). I have not received any documentation from the company validating the debt, proving ownership, or explaining why they reported these incorrect dates.
