I am submitting this personal statement, along with my official FTC Identity Theft Report and supporting documentation, to formally notify the Consumer Financial Protection Bureau that I am the victim of identity theft and inaccurate credit reporting in violation of the Fair Credit Reporting Act ( FCRA ) and the Fair and Accurate Credit Transactions Act ( XXXX ). There are accounts currently showing on my credit reports that I did not open, authorize, or consent to. These accounts are causing immediate harm to my financial position and future creditworthiness. I have followed all legal steps required under the FCRA including filing an FTC Identity Theft Report and now request CFPB enforcement to have these disputed accounts : Blocked, suppressed, and permanently deleted from all consumer reporting agencies within XXXX business days as required by FCRA 605B ( 15 U.S.C. 1681c-2 ). LEGAL BASIS FOR REMOVAL WITHIN XXXX BUSINESS DAYS Under the Fair Credit Reporting Act, after receiving proper documentation of identity theft ( which I have provided ), the credit reporting agencies must block and remove the disputed accounts within XXXX business days : FCRA 605B ( a ) ( 1 ) ( A ) Requires a credit bureau to block reporting of disputed information within XXXX business days after receiving : XXXX. A written request ; XXXX. Proof of identity ; XXXX. An identity theft report ( XXXX ) ; XXXX. A statement from the consumer specifying which accounts are fraudulent. FCRA 605B ( b ) States that any account resulting from identity theft must be permanently excluded from the consumers credit file. FCRA 611 ( Dispute Process & Duty to Reinvestigate ) Requires a reasonable reinvestigation and removal of information that can not be verified as accurate. FCRA 602 ( A ) Purpose Protects consumers from unfair and erroneous credit reporting and mandates maximum possible accuracy. VIOLATIONS & NONCOMPLIANCE I hereby allege the following FCRA violations by the credit bureaus and/or furnishers : Violation FCRA Law Breached Continued reporting of fraudulent accounts after FTC report submission FCRA 605B ( a ) Failure to block/remove accounts within 4 business days FCRA 605B ( a ) ( 1 ) ( A ) Failure to conduct reasonable reinvestigation FCRA 611 ( a ) ( 1 ) ( A ) Reporting information with no permissible purpose FCRA 604 Failure to ensure maximum possible accuracy FCRA 602 ( A ) NO VERIFICATION OR INVESTIGATION IS PERMITTED Under FCRA 605B, once an FTC Identity Theft Report has been submitted, the CRA can not delay , verify, or reinvestigate the disputed accounts. FCRA 605B ( a ) ( 5 ) PROHIBITS any verification process A consumer reporting agency shall not require further documentation or conduct any reinvestigation once an identity theft report has been submitted. FCRA 605B ( c ) ( 1 ) Furnishers are prohibited from continuing to report disputed information after notice of identity theft. Therefore, any attempt to verify or reinvestigate violates federal law and constitutes willful noncompliance under FCRA 616 & 617, exposing the credit bureau and/or furnisher to civil liability.
